ELS files suit against Apple for 'Mac Manage

ELS has filed a lawsuit against Apple on September 20th in a US District Court in Florida after unsuccessful negotiations with Apple over Apple's unauthorized use of ELS’ trademark "Mac Manager."

The suit alleges that Apple willfully infringed ELS' trademark rights in 'Mac Manager' by adopting a confusingly similar mark for the same type of software product. The suit also alleges dilution, unfair competition, and injury to business reputation.

ELS says it has been selling its desktop security product under the Mac Manager name for over six years. ELS' product has special appeal to the education
industry where network administrators in shared-Mac environments need to
control user access to files. Apple has competed with ELS in this area for many
years with Apple's "At Ease" and "At Ease for Workgroups" desktop security
products directed specifically to the home and education markets, according to ELS.

Apple then replaced its At Ease product with "MACINTOSH MANAGER" as part of its new OS X Server operating system, which lead to confusion according to the press release. ELS says that "soon after Apple’s adoption of the new name, customers began mistakenly contacting ELS to report problems with 'Mac Manager' and that it was forced to explain that the problems were with Apple’s MACINTOSH MANAGER and not its Mac Manager product


ELS says it has over 100 pages of emails, web sites, and mail list postings documenting the severity of confusion and the company receives complaints
almost on a daily basis. "Maybe it would not be so bad if it was good press;
but all I hear is how bad the Mac Manager product is. I couldn’t give away
my product now. Apple has essentially put me out of business."

ELS says it gave Apple every opportunity to resolve this dispute without litigation; however, "Apple just didn’t take us seriously. Filing this action, however, should be a clear sign that ELS is serious about enforcing its rights."

    Mac Managers themes

    Well if this suit makes it to court, Apple can counter sue them over the use of using Hi-Tech and Gizmo in their program.

    this is pretty much bull though. The programs are for two different operating systems (OS X Server compared to OS 7-9) I don't see this working out well at all for this one man show.

    Mac Manager sucks

    I think all the "Mac Manager sucks" e-mails were in fact meant for Mac Manager! I have used both and Apple's Macintosh manager kicks Mac managers you know what.

    Mac(intosh) Manager

    Actually, Macintosh Manager is for 7.x through 9.x, and I think also X. As for it being a bad product: I am an Apple Campus Rep, I've set up more than one lab with it, and I've heard no complaints. (At least none that weren't directly traceable to our really bad campus network.) I haven't had to go back to a lab to do any problem solving, etc. (Of course, I check in from time to time just to make sure everything is okay.)
    According to ELS's site, Mac Manager has been out since 1996. Apple's Macintosh Manager has been out since AppleShare IP 6.1 at the latest, so 1999. Why has ELS waited so long to file this suit? Almost three years is a long time in the computer world, especially if there's been "over 100 pages" of confusion. Sounds odd.

    Doesn't all Apple have to say is that the other company is using "Mac" to mean "Macintosh" so the other company is using an Apple name on it's own product?

    You can't write "Windows" without M$ jumping down your throat.

    i agree. doesn't apple have a trademark claim to the "Mac" brand? if not, then alot of companies could use the brand to their own benefit.....maybe even to the point of making a "mac" computer. i dont understand this. the problem is that in using the name "mac" to signify anything in the computing world, including software, you would have to be referring to use on some apple product. right??????

    someone please shed some light on this??

    i also use macintosh manager since os x server 1.0 and i t does KICK a**....the only thing i could see them (MAC Manager) complaining about is people incorrectly emailing them for tech support, but apple's product is by far superior.......

    The word "Mac", very very common; the word "Manager" common as all get out, especially coming from M$. It should have been apparent to this company that such a name for a product would be risky. If I had this name for a product I would have changed the name of my product immediately to make the distinction. For all we know this company may have benefitted initially from the name as much as they were hurt, thus the delay in pursuing the issue. I didn't know about ELS's product until I went looking for Apple's MM info years ago.
