Microsoft requests new trial in DOJ case

Microsoft asked the U.S. Supreme Court for a new trial in its antitrust case, saying the judge's discussions with reporters "infected the entire case...[and it] didn't go far enough when it threw U.S. District Judge Thomas Penfield Jackson off the case while leaving much of his ruling intact."

    TACKY

Does anyone else think it's really obnoxious for Microsoft to have thennerve to release
this press release while the country is pre-occupied dealing with the
greatest tragedy of our nation's history?

I mean, I'd rather hear about them donating $500 million to Red Cross. That would be a better way to change the tide of public opinion in their favor -- and h***, maybe they'd HELP people in the process.

    Re: Tacky

Actually, Microsoft has donated $10,000,000 combined in cash and hardware software ($5Mil apiece) - of course you've got to go to MacMinute.com to see that.

There's nothing tacky about their timing on this. Businesses and others must keep going. If everyone stopped indefinately, our economy would suffer even deeper.

All that said, this seems like just yet another stall tactic and 11th hour ploy by MS to try to outwear the Justice Department. They probably figure they have a better shot with the new adminstration that has already gone soft on them by saying they will not seek a break-up order.

Microsoft should shut up and issue a press release about donating millions of dollars to the relief effort.

They already won, subverted the system and the government. Now they are just rubbing it in.

    doesnt anyone...

...think that this is scary? M$ is basically more powerful than the US gov.

My deepest sympathies and respects go out to all of those that are trying to cope with this horrible occurance (the attack on America).... but.... I think the crazy terrorists attacked the wrong superpower. If they really wanted to bring down the highest power in the world, why didn't they just attack microsoft's headquarters? I don't wish any harm on ANY human being but, seriously, it appears that M$ is more powerful than any business in the WTC or any dept in the Pentagon.

You are exactly right. Bill Gates is more powerful than any individual in the US Government. The fact that he could donate $10B demonstrates that. It would require the agreement of dozens of US gov from various branches people to come up with that kind of money.

BTW, that $10B is not quite as generous as it looks. $10B in MS products is the profit MS would theoretically make if they sold that volume, which of course they couldn't, especially in today's climate. For MS it's well spent. If MS can get more gov people thinking the public is sympathetic to MS, the US'll give MS a medal and apology instead of a punishment for its criminal acts.
