Appeals Court denies Microsoft delay request

The U.S. Court of Appeals for the District of Columbia Circuit has issued an order denying a request by Microsoft that could have delayed further proceedings in its antitrust case until the Supreme Court decides whether to hear the appeal, according to c|net. The mandate to return the case to trial court will be issued next Friday, which means that the Justice Department can resume proceedings in front of a federal district judge shortly.

    A Microsoft breakup would be be in the best interest of
    all software companies world wide. Imagine IE, Word, and Outlook Express standing on their own two feet for change.

    who's to say that a breakup would keep the "baby MSes" from being in cahoots behind the scenes? what would keep them legitimately independent?

    i'd love to see MS brought low, lord knows it is deserved, but how to do it?

    Will this actually mean someone or once again will the devil escape only to become bigger and stronger. Let's hope the court does not say "Your punishment is 3 lashes with a wet noodle.. now go back to your room and try not to bundle Excel into Windows XX."

    a breakup is a tricky

    proposition.

    Violations of the Sherman Antitrust Act are punishable with prison sentences. Instead of punishing Microsoft, punish the people within Microsoft who engineered Microsoft's illegal activity. People like Bill Gates, Allchin, Ballmer, Kempin, etc.

    Put enough of Microsoft's criminal employees in prison and a divestiture won't be necessary.

    This is a point I have heard raised many times. I think that I have something to add to it. Let us not forget that Windows gets support from M$ products, not the other way around (well, it does a bit). Since it would not be in the best interests of the applications department to alienate potential customers in other markets (Linux and Palm, for example), we would see M$ products on these platforms. This would be beneficial to all computer users and would dramatically weaken the control that M$ has over computer users.

    Just my thoughts,
