Apple wins against Imatec in lawsuit

For the second time, Apple has successfully defended itself against plaintiff's accusing the company of using patented technology for ColorSync. The U.S. Court of Appeals for the Federal Circuit upheld a lower court's decision to throw out Imatec's case against Apple.

    No, Apple didn't successfully defend itself. It didn't have to because the case was thrown out *before* going to trial. What Apple did was to "challenge" the case. If MacNN is going to use legal terminology, then it should get it right.

    Actually the report is correct according to the release. The federal court in New York not only ruled that ColorSync is non-infringing, but that Imatec did not own the patent it claimed. If this is the case (I obviously haven't read the original ruling so I'm going on the assumption that the report on Law.com is correct), not only did Apple win the case on the merits, but the filer of the case is barred from pursuing it further because he lacks standing. A district court ruling doesn't set precedent so it's possible the holder of the "patents" could attempt to sue, but it would be a difficult case since the court already ruled that ColorSync didn't infringe.
