MixThePix shuts down in frustration over illegal use

MixThePix shuts down

Due to continued unauthorized use of its icons by commercial software makers, has decided to close is Web site indefinitely. "I want to thank everybody for their support, but unfortunately it didn't help," a notice on the site reads. The site proprietor blames ADNX Software for illegally using MixThePix's icons, and refusing to remove them from their products.

ADNX clearly don't understand copyright. When you create something, you instantly have copyright protection. His icons are his to create, and to use them commercially, clearly they need his permission. If he won't give it, they shouldn't be using his work for profit. End of story.

i wrote to ADNX

and got a surly, smarmy frenchie response. its these a******* that give french people a bad name really. go to the south of france, outside that hole of a city they call paris. this wouldnt have happened there...damn parisians.

but off of THAT particular rant, they contended that something that was released "in the wild" so to speak is fair game. they also noted in a response to my email about their activities that they upheld french copyright law first, above american. well whatever, but hey they didn't sound like the update with the changed icons would be around anytime soon.

i say DDoS the h*** out of ADNX. or just post this on slashdot...

if anyone cares, here was my email, verbatim to ADNX when this was all initially going down and they had posted their "official" response:

so let me get this straight, the crux of your argument against the webmaster/icon designer consists of:

1. we're french, and while we may happily SELL our products to the U.S., we will not respect their laws when they are in conflict with our own.

2. he didn't explicitly say we couldn't necessarily use his icons in one of our products, so rather than using any shred of common sense or best practices in software development, we decided it was in everyone's best interest to simply use his work and never cite him as the original author.

3. if they don't want it used without their permission, they shouldn't make it available for free, which means that any piece of creative work, so long as it is available in a public space, virtual or not (for example, a photograph of an outdoor mural or museum piece) can be used freely in a commercial endeavor without citing the original author's work.

you have got to be kidding me.

and a lawyer actually told you that you were right in this issue???

but of course, you plan to update your software with "new, cool icons" for their next release... wow, like that icon for the kids browser, which, um, is a nondescript small humanoid figure and a big yellow... arch? how exactly does this say either "kids" or "browser" or even your corporate branding?

when looking over your work, it becomes clear that you simply don't know HOW to make good icons, and would rather use someone else's time and effort rather than hiring someone to do it right.

in fact, i wish i had some coding experience, because i am fairly sure that several of your software products are simply re-skinned versions of other people's software, and hoping the the GNU public license for the underlying frameworks will save you in a court of law. i hate to tell you this, but regardless of continent, you wouldn't have a leg to stand on.

i will be advising every colleague i know to avoid any piece of software coming from ADNX or even appMac for the foreseeable future.

They should Pay

What they SHOULD do... is pay the artist at MixThePix a small percentage for EACH copy of their software that they sold... which incorporated his icons. If they use his icons and modify them... they should still pay a percentage - think of it as using part of someone's program code... embedded in yours... even though you may change it ever so slightly... you didn't develop it. They didn't develop the icons or they modified his icons so they should pay him for that.

Please explain

I'm not trying to say that the ANDX is in the right. I'm just wondering if someone can help me understand. I too have used these icons... but was always under the impression that they were Freeware, or bascially royalty free.

I too never saw any copyright info, even looking back at the ones I downloaded. So please explain. If they are freeware, doesn't that usually imply that they are free to use? Seems like most companines post a non commercial version, or free educational version, rather then a freeware version that is shareware for commercial use? So I guess I was confused by this too. Am I wrong in my logic.

That being said, I'll be the first to appologize if I've used one of these icons incorrectly, or against the copyright agreement. Don't believe that I have, but if I did, it was by know means intentional.

That being said, I'm sad to see the sight go, I wish I had 1/5th the artistic cababilities that artisit does. I love going to his sight, just to get inspiration for projects I'm working on. I think MixThePix site is full of talented work, and I hope they are able to receive the recognition and support the ask for and rightly deserve.

Just because they are 'freeware' and free to use, there's a license somewhere that would tell you this. Usually you're given the right to use the icons for 'personal' use. Which means on your computer, maybe in programs you write. But there usually is a proviso that you can't use them in commercial products or to make money off of them.

If you look at the license of a lot of shareware/freeware (esp. the older stuff), there's usually something that says "If your compiling a CD for distribution to others, you must get permission to include my software".

In other words, freeware means "Free of charge", but it doesn't mean "Free to do with what you want:" If the software/resources are released to the public domain, then its up for grabs.

not to put words in your mouth, but there is a little more to it... namely, at least us copyright protects creative work EVEN IF there is no expressed restrictions. basically, there MUST be a good-faith effort placed in order to contact the creators (or the estate of the creators) to use a work in any commercial sense other than its original intent.

think of it this way... you can't go up to any outdoor mural, take a photograph of it, then use it in your brochures to sell hondas or chryslers, unless there are special circumstances surrounding the piece (i believe national landmarks and the american flag, for instance, may be only loosely tied to this rule or exempt outright, though i'm hazy on exactly why).

also, as any street cop will tell you, "ignorance is not an excuse for breaking the law." there isn't a law on earth that protects a software company that didn't even bother to shott him an email telling him what they were about to do. that's just assinine.

and i think hein at mixthepix has done really the only thing he can control... his site. just ask the guys at iconfactory about this little issue. whenever i caught a website using their icons without permission, i told them. in some cases, they could get the developer to stop. but in others (i actually caught macromedia using their icons to sell macromedia central with screenshots), macromedia essentially held firm with the attitude of "what are you going to do, sue us? we're fn' macromedia!" (not an exact quote). so the iconfactory guys did what they could, which was a two pronged solution:

first, if you noticed, the guys at iconfactory STOPPED making truly generic icons, and focused their efforts over the past six months on either off-the-wall themes, or icons, but with so much "personality" that people would recognize their work, and any one icon used from their sets would seem out of place. so they essentially force a developer to steal the WHOLE set if they want it to look right.

if that fails, then...

they started stockicons.com, where they DO sell great generic icons that developers would want, but then watermarked them, and only offered small samples to whet the appetite.

i think a lot of icon developers could learn some important lessons from them.

What a hissy fit! OK, this company is in the wrong, but you get your legal team on to it, not going crying to mommy and taking the ball with you.

Although personally, i don't feel much of a loss here. It's always confused me as to why his icons were so universally praised, I found them to be quite ugly and unpolished. Fantastic for a hobbyist, yes, but not up to scratch for a professional icon designer.

Again, the archive we used was saying that we can use icons for free ! Do you always verify the information on each archive ? I say no ! The artist will have the same problem in the future because a corrupted archive is available on the internet. Also, he publish private email on internet and don't say the truth about the story. look, whether or not you like hein's work is immaterial... it's the difference between right and wrong. the difference between best practices and "gosh, think anyone will notice?" yes, hein "takes his ball and goes home" -- what else would you have him do? sue? over freeware icons? the transatlantic fight would be undoable. so what other recourse does he have? what, you want him to just keep them up for adnx or whomever to use? no way. mixthepix is well-known, and i hope to see mixthepix back after this gets settled. adnx, however, can stop acting like this is some holy war they are fighting. you screwed up. i can forgive that. but your idiotic holier-than-thou attitude has been off the scale... I think that your defense of using MixThePix's icons is poor. If you found those icons in a "bad archive" on the Internet, it is YOUR responsibility to find out just WHO the author is so that you can compensate him/her properly, especially if you plan to use it in software that you plan to re-sell.

If you think that the icons are not copyrighted, then WHY are you changing them in your software? To keep the artist happy?

I don't think so.

Why should you care about the artist if you think that the icons are not copyrighted? By changing them, you are admitting that you were wrong.

I don't know what your company does and, frankly, I don't care.

Since you admit to using the icons (and, thus, changing them) I think that you owe the artist an apology and proper monetary compensation for those software titles you have already made money with. Send the guy some money and you will show that you made a mistake and are willing to make the situation better.

Bad archieve or no

You took someone else's designs and didn't give them credit, and that is a huge no no. Worse, you included those designs in a commercial package. Finding a "bad" archieve on the internet doesn't cut it. Just because the author screwed up and didn't include any sort of licence with his icons is not an excuse for you to rip off his work. And no, you can't just change a few pixels in a freeware icon set and call it your own. You're supposed to design your OWN icons, not take someone elses. If you can't, hire somebody who can. But don't steal someone else's designs and then complain when you get caught.

French or English, both have the concept of fairness. What's fair is that you either remove the infringing icons, or at least provide some sort of compensation to the author who created them. Just do the right thing- that's all people want. You've already created a huge amount of negative publicity for yourself, which will likely lead to lost sales. To delay in apologizing and correcting this problem is to commit your own suicide.

Please RESPECT INT'L LAW

Firstly, you may be forgetting that Apple is a all American made company. If you are touchy about your French credits, you should rethink this.

If you think that you only abide/respect your own country's laws, does this mean that if you commit an offence in another country you can go scott free just becuase you are foreigner? ridiculous!

I am neither a French or an American. As an artist myself, I have experienced my fair share of people 'using' my works and outrightly claim to be theirs and have the audacity to publish it. This is a serious issue as copyright infringements are applicable for law suits and convicted offenders can be pronounced bankrupt due to high compensation fees (mind you, I have encountered quite a lot of such cases these days). Copyright regulations are international. As long as you create something, it is copyrighted to the creator by DEFAULT.

As a human being, it is clearly wrong to use another's effort for profitable usage. Is so difficult to courteously admit, apologise and compensate the victim? If you would have done so, none of this would have been blown out of proportion.

How does one classify archive as bad? Where did you download it from? From a pirate server? hmmmmm.....

Bottomline, nobody feels good getting ripped off and I am sure you would not like someone else doing this to you.

Its the beginning of a New Year, let's not s**** it up. Mother Earth does not belong any nationality. Make love not war. Peace...

It amazes me how much c*** we free content providers on the net deal with, the level of people's bullshit, and the increasing attitude of entitlement on our creations.

I get peopel demanding I make them things, how I need to make that - people, I do this for MY enjoyment. I share with you at MY pleasure. YOU HAVE NO RIGHTS TO ANYTHING.

Everyone, please send Hien some money for all his trouble and maybe let him buy himself something pretty and maybe change his view of humanity.

You'd be surprised how little we pixel artists get considering the acclaim and traffic - i find more in my couch cushions. Every little tiny donation i get is like a little award. It means more than you could ever believe and for another week makes me feel it's worth the trouble.

Hein here,
the thing is that these people first start to shout and scream because I said they can't use my freeware icons fro free. And only when I shut my site down they got rid of the icons, but never ever said sorry or something like that.
They still believe that they are in their rights.

Even now when they said they made new icons of their own it's not true.
These icons are also stolen except from other icon developpers. But they probably said that they had a bad archive again with no read me file. All my iconsest have a read me file with it but still they found one without it... ?!
Somebody must stop this company and companies like them.

The thing is that this happenes to a lot of people that make freeware on the internet and that it is hard to fight against it, and that shutting down my site is the only way of making a point and hope that other companies will be more carefull with what they use what they find on the net.
