Apple being sued over 'Unix' trademark

Apple is being sued by The Open Group, the San Francisco company that claims ownership of the Unix trademark, for in conjunction with its Mac OS X operating system without a license, reports c|net: "Apple has countersued, asking a judge to declare that the trademark is invalid, because the term Unix has become generic. Though initiated nearly 18 months ago, the case has not yet gone to trial. According to a motion filed with the court Tuesday, both companies want to have an exchange of factual documents completed by August, with a trial sought for February."

    Love companies that lie in their name. The Open group! How open is that, suing over the use of a name? Apple's right, though, it, like Aspirin, should be public domained by now. With so many variants, how can they all be Unix?

    And I thought it was UNIX, not Unix? Oops, I mean Unix®.

    And if not, I want it known now I'm trademarking the name PC?. Pay me now, or suffer the consequences!!!

    Standards Certification

    Opengroup wants $110,000 to certify that OSX is compliant with all Unix standards. 110 grand is peanuts to Apple. Their legal fees for this countersuit will probably cost millions. If OSX is really a Unix compliant operating system, why not just pay the certification fee?

    Apparently, be because it isn't. Posts on slashdot bring up points such as directory structure, which differ. So...it is "like" UNIX, but not UNIX.

    Directory Structure

    I have yet to find any two Unices which have identical directory structure. What defines Unix are more the API's (POSIX) and the multi-user aspect.

    Anyway, this is c***. Apple is counter-suing in order to settle this issue once and for all.

    Give me a break. Like anybody needs The Open Group to verify that BSD is Unix.

    Apple's is "mostly" POSIX compliant. They made some choices that benefit integration, so be it. Most of POSIX is there. Are they going to abondon Aqua in favor of X11?

    A true UNIX would have a heck of hard time being a good desktop. I am glad that Apple gets to pick and choose, is there freaking OS not SCO's.

    To say OS X is or is not "Unix" is largely a subjective thing. Most Unix-ish platforms are not "true Unix" but it doesn't matter, because they're close enough that nobody notices. Speaking as someone who's developed for most every platform out there (including OS X), OS X is hardly a hack. OS X is a great Unix in all the meaningful ways, regardless of pedantic details.

    But what's most absurd is that Apple has done more for Unix with MacOS X than any other company in recent history: it has truly brought Unix to the masses. Linux never has and never will (sorry), and Linux isn't Unix, either. The Open Group is irrelevant these days -- all the old school unixes are dead or nearly dead. If a box is running "Unix" today, it's OS X or Linux.

    UNIX BASED

    Apple claims is UNIX BASED, not that is UNIX. OSX is based on a UNIX core, Darwin is a VARIANT of Unix, apple arent claiming that OSX is 100% identical to the original UNIX, and quite frankly neither are most other unix variants. these guys just want money.
