Tri-EDRE, FWB in dispute over backup software

[Updated] We continue to cover the dispute between Tri-BACKUP and FWB regarding the Backup Toolkit software package.

FWB's vice-president of Sales and Marketing, Mark Prewitt, contacted MacNN to offer alternate perspective on the matter. Mr. Prewitt writes "We were given an exclusive 1 year agreement starting in August of 2002." He continues "We have received no written notice of cancellation from Mr. Rolland [...] we are in our full legal rights to continue to distribute and pay Mr. Rolland for his software, despite his claims of piracy, and breach of contract." Moreover, Prewitt alleges that Tri-Edre is currently in breach, and "had no legal standing to change distributors without advanced notice." FWB says it finds Tri-Edre's stance "baffling", and insists that it has done nothing to provoke Tri-Edre's actions.

    why?

    Why would you penalize your customer. Deal with FWB but don't spite the customer who purchases your product. Hurt feelings have no place in business.
    I bought the FWB product when it first came out expecting a true FWB product. I was disappointed to find out it was a rebranded product. Later I discovered that it was actually a good thing and that Tri-Edre allowed me to use the unbranded version and the subsiquent updates. I've enjoyed being a Tri-Edre customer until the last update required me to pay again.
    Hope you guys work this out.

    FWB Software is currently involved in a legal dispute with Mr. Rolland and Tri-Edre over his breach of our exclusive US distribution agreement of his software that expires in August 2003. We are sorry that he has decided to make our private legal issue public. We don't think it is in the best interests of our clients or his to take this public and feel it should be handled in private. We apologize to the Mac community for this embarrassment. FWB is committed to our end-users and wish them to know that we will have a better option than Tri-Edre's shortly.

    FWB has illegally sold unlicensed software in the past to other companies. Their management needs to get hit with a lawsuit. Problem is, there isn't enough capital behind them to make it worth it. Blergh.

    Not customers

    If a company is illegally pirating your software, selling it to users against contract, then not paying royalties it would seem unfair to expect that developer to wear the support costs of those sales. The best thing to do is let users know as publicly as possible. Users need to know of what FWB is doing, and where to get the legitimate supported version of the software. Its a very difficult situation but actions like those taken by FWB put everyone in a difficult position. Its just plain SAD when things like this happen.

    FWB still paying....

    I emailed and asked and they claim that they are contiuing to abide by their contract and paying Tri-Edre for their sales of Backup Toolkit and that Tri-Edre signed up Prosoft while they had a contract with FWB. This is just a big fat contract dispute. Big deal.

    Does it work yet?

    I have yet to see this program (whatever it's called) succesfully create a working backup of the OS X boot partition. There are always some errors reported, and no copy has sucessfully booted for me.

    All this corporate sniping, over a program that STILL doesn't do one of the major tasks it's designed for.
