On October 18, the US Patent & Trademark Office published two of Apple’s iPhone Design Trademark applications respectfully numbered 77303256 and 77303282. In both applications, Apple has filed for iPhone design trademark protection under International Class 009 which is detailed below. Apple’s design trademark applications were accompanied by an unprecedented number of evidence specimens, numbering more than 170. Most of the evidence presented consisted of newspaper headline and/or cartoon PDF’s.
Apple’s Mark Description
The mark consists of the configuration of a handheld mobile digital electronic device. The matter shown in broken lines is not part of the mark.
Apple’s latest trademark filling covers the following International Classification details.
International Class 009: Handheld mobile digital electronic devices for use as a mobile phone, digital audio and video player, handheld computer, personal digital assistant, electronic organizer, electronic notepad, electronic calendar, calculator, and camera, for sending and receiving electronic mail and other digital data, and for accessing the Internet.

It’s interesting to note that under the trademark application’s Additional Statements Section, Apple filed an unprecedented number of specimens exceeding 170 individual PDF’s in support of the iPhone. The second trademark design application number 77303282 was accompanied by the specimen noted on your right. The remainder of the application appears to mirror that of the primary application, though careful review may prove otherwise.
