On February, 21, the US Patent & Trademark Office published Apple’s latest trademark application for Cover Flow under application number 77107545. Apple’s documentation presents the trademark as being filed under a simplified version of International Class 009 covering computer software for browsing the contents of a library of music or video files . The documentation further notes that the trademark was first used in commerce at least as early as September 12, 2006, and is now in use in such commerce. Apple’s submission pertaining to proof of commerce consisted of a screen capture of their iTunes download page (duly noted below) where the Cover Flow mark is used in association with the computer software product at point of distribution.

Apple asserts a claim of priority based on New Zealand application number 753484, filed on August 18, 2006. MacNN reported on this filing on September 18, 2006 which also covered International Class 009 in its entirety as Apple’s application presented it.

Apple’s application was filed by Thomas R. La Perle of Apple Inc. on February 14, 2007.
