Testimony: Google providing indemnity to Samsung in patent lawsuit

Google's Mobile Application Distribution Agreement spells out defense aid

Google attorney James Mccoun testified today that the search engine giant agreed to defend Samsung at least in part against some of the claims against it in the ongoing Apple versus Samsung trial. Apple played pre-recorded testimony from the attorney, who confirmed emails that said that Google would provide some level of indemnity over four patents held by Apple if Samsung was sued, or would possibly take over defense of the claims.

Google agreed to the defense sharing in the "Mobile Application Distribution Agreement" when Samsung agreed to provide Google services such as Gmail and the Google Play store on its Android-powered devices. Apple presented the emails to refute Samsung's claims that it shouldn't be sued over the Android features, as the patents in question were potentially violated in core Android, provided by Google itself. Two of the patents at stake in this trial are covered by Google's agreement with Samsung.

Apple's prosecution of the five patents at stake in this trial that it owns have taken the majority of both companies' allowed 25 hours for presentation and defense. About two hours remain for Samsung to press the two patents it wants asserted against Apple for FaceTime and other technologies.
