German court tosses two IPCom lawsuits against Apple, one vs. HTC

One Apple suit valued at almost $2.2 billion

Germany's Mannheim Regional Court has dismissed two lawsuits against Apple and one against HTC, all of which were brought by IP holding firm IPCom, reports say. The cases revolved around a set of standards-essential 3G patents IPCom bought from Bosch after the latter exited the carphone industry. One of the suits, had it been successful, would have have demanded almost $2.2 billion in damages from Apple.

IPCom may choose to appeal, but faces the risk that Apple and HTC will successfully push to have an underlying European patent (EP1841268) invalidated, along with related properties. The same patent family has also been used in actions against companies like Nokia, Ericsson, and Vodafone. IPCom hasn't seen much success, but did win a settlement from Deutsche Telekom last year.

Apple is among a number of corporations that are lobbying the European Union to make it harder for companies like IPCom to proceed. Under proposed rules, limits would be placed on injunctions and court proceedings when a patent's validity is still debated.
