Apple files to renew bid to block sales of infringing Samsung devices

Company avoids demanding rehearing

Apple has submitted a motion to renew injunction efforts against Samsung products violating three of its patents, reports say. Back in November the US Court of Appeals for the Federal Circuit asked District Court judge Lucy Koh to reconsider Apple's case in terms of patents for rubber-banding, pinch-to-zoom, and tap-to-zoom functions, but at the same time supported the denial of an injunction based on asserted design patents. The Court of Appeal issued an official mandate for its decision on Thursday, at which time Apple quickly filed the motion to renew.

The company could have chosen to stall by petitioning for a rehearing, but appears to be concentrating on other matters, namely its next trial. The products Apple is renewing its efforts against are largely out of date, now marginal or off the market entirely.

The pinch-to-zoom patent is also controversial, since the US Patent and Trademark Office has questioned its validity. Last month a patent examiner found all of the claims in the patent invalid, which yesterday led Apple to file for an appeal with the Patent Trial and Appeal Board. As for the renewed injunction efforts, Apple is asking to have proceedings underway at the District Court for the Northern District of California as soon as January 30th.
