Apple makes closing arguments in Apple v. Samsung retrial

Company claims documents, absence of Samsung execs aid case

Apple today made its closing arguments in the Apple v. Samsung damages retrial. A lawyer for the company, Bill Lee, argued earlier on Tuesday that documents were Apple's best evidence. Presenting to the court, Lee once again referred to images of Samsung devices pre- and post-iPhone, as well as internal Samsung communications. "In some ways our best witness is Samsung," he claimed.

The attorney also suggested that the absence of Samsung executives during the retrial was significant. "Samsung brought you no one to explain how they develop their products and why they developed them in an infringing way," said Lee. Apple previously brought in executives such as marketing head Phil Schiller, who argued that Samsung imitating the iPhone "weakens the view that the world has for Apple," and has caused people to "question our innovation and design skills in a way that people never used to."

The case should go to jury later today, once Samsung's own closing arguments are submitted. At stake is a portion of the damages from the 2012 Apple v. Samsung trial, which judge Lucy Koh ruled was based on improper calculations by the jury. Apple claims it should be paid $379 million, while Samsung maintains a proper amount is $52 million.
