France promises to sanction Google over privacy policy

Company fails to comply with demands

France's data-privacy watchdog, the CNIL (Commission nationale de l'informatique et des libertÚs), has moved forward with plans to sanction Google over the company's privacy policies. The agency in June ordered the company to implement a number of changes to comply with the French Data Protection Act, however the company reportedly failed to adjust its policies within a three-month deadline.

"The formal enforcement notice of 20 June follows an analysis by European data protection authorities (united within the Article 29 Working Party) of the new privacy policy that Google implemented on 1 March 2012," the CNIL wrote in a statement.

The agency demanded that Google change its privacy policy to define "specified and explicit purposes; inform users with regard to the purposes of the processing implemented; define retention periods for the personal data processed; not proceed, without legal basis, with the potentially unlimited combination of users' data; fairly collect and process passive users' data; and inform users and then obtain their consent in particular before storing cookies in their terminal."

In private communication on the last day of the three-month time limit, Google allegedly disputed the reasoning behind the CNIL's demands and the applicability of French data protection law to its services.

"In this context, the Chair of the CNIL will now designate a rapporteur for the purpose of initiating a formal procedure for imposing sanctions, according to the provisions laid down in the French data protection law."

The agency has yet to disclose specifics surrounding potential punishment, such as fines.
