OtterBox wins $2M judgment in counterfeiting case

Company has won more than $11M in court victories so far

Case and accessory maker OtterBox has won another court case against a counterfeiter, gaining a $2 million verdict against S & P Trading, a New York-based company that was found guilty of selling at least 146,000 fake OtterBox cases. The company has aggressively gone after unauthorized replica makers, and in 2012 helped US Customs seize 118,000 other counterfeit items, and won other court cases against bogus product sellers for a total of nearly $11 million. OtterBox holds more than 190 patents in the US and 110 trademarks worldwide.

The judge in the US District Court case found that S & P Trading had violated the Lanham Act by purchasing and selling the counterfeit cases, which were likely made in either China or Taiwan. The cases violated OtterBox's trademarks, he said, and issued a permanent injunction against the reseller, reports AppleInsider.

OtterBox CEO Brian Thomas praised the decision, saying that the company "was built on bringing our customers innovative, first-to-market products. Counterfeit products damage our reputation for delivering premium quality products because many customers aren't aware that they purchased a fake OtterBox."

Echoing other technology CEOs of note, Thomas added that "a lot of design, engineering and testing goes into each of our custom protective cases, which is why we take a hard line with companies creating and selling fake cases, as well as those infringing on our patents and trademarks." He warned consumers that "if a deal seems too good to be true, it probably is."
