Nokia pulls power conservation patent from ITC complaint against HTC

Three patents remaining, action limited to older devices

Nokia has withdrawn a single patent from its first US International Trade Commission (ITC) complaint against HTC. Patent number 5,570,369, entitled "Reduction of Power Consumption in a Mobile Station" -- a patent Nokia used to win a sales injunction against HTC for infringing in a court in Germany, has been struck from the complaint at the ITC without a listed reason.

Patent analyst Florian Mueller believes that the withdrawal is "most likely attributable to procedural differences between the US and Germany. In the US, there is extensive third-party discovery, and this may have helped HTC there. In Germany, HTC's problem was that it couldn't deny Nokia's infringement contentions because it couldn't obtain certain information from its chipset vendors." US ITC investigations invite and require third parties, like chip manufacturers, to participate in the proceedings.

Nokia still has three patents involved in the action -- an Internet connection tethering patent, a RF broadcast and reception patent, and an interference-limiting patent. The patents are being asserted against a wide range of devices, but not against the new HTC One handset, which is being attacked in a different ITC complaint in the US.
