Judge blocks class certification in job poaching lawsuit

Decision may be reversed later on

US District Court Judge Lucy Koh has denied class action status for workers wanting to sue several major technology and film companies over anti-job poaching practices, Reuters reports. The plaintiffs have accused Adobe, Apple, Google, Lucasfilm, Intel, Intuit, and Pixar of conspiring not to poach workers from each other. While such practices might help stabilize corporate environments, they also reduce the need for employers to compete with each other on wages and benefits.

In her ruling, Koh states that there isn't enough evidence to justify class certification yet. She has however signaled a willingness to revisit her decision, which if reversed would escalate the scale of the case.

Despite macroeconomic worries, the US high-tech job market can still be extremely competitive, particularly in Silicon Valley, where most of the companies in the lawsuit are based or have a major presence. Companies like Apple and Google are known for offering perks for new hires that are rare in other industries.

    Bad decision

    This seems like a bad decision by the judge. While I do think that such workers are rarely underpaid I don't see how they can't be considered a class under attack. If you can't switch jobs just because you're part of a group when that seems just wrong.
