Dutch court: Samsung does not infringe Apple multitouch

Samsung wins in Apple infringement complaint before Dutch court

A Dutch court has ruled that Samsung does not infringe an Apple patent in its implementation of certain multitouch gestures, reports Reuters. Apple had the opportunity to put forward its case in The Hague court in September, with the court's ruling only handed down now. Apple argued that Samsung's devices infringed upon patents it holds allowing users to use two fingers on a touch screen simultaneously, including 'pinch to zoom.'

"With these products Samsung does not infringe the claims that Apple has made," reads a statement from the Dutch court. It is not the first time that a court has ruled against Apple on its multitouch patents. Apple has previouslly lost similar cases against HTC in Britain and Samsung and Google's Motorola in Germany. Samsung naturally welcomed the ruling, while Apple has yet to issue a statement.

The next critical ruling in the ongong court battles between the two tech titans comes this Friday, when the International Trade Commission is due to rule on patent infringement claims by Apple against Samsung. Although Apple has claimed the biggest win between the two companies in a Californian court, which awarded Apple over $1 billion in damages, the award could be in some jeopardy. On Tuesday, the US Patent Office revised a ruling on Apple's 'rubber-banding' patent, invalidating all 20 Apple claims.
