Judge shoots down Samsung's claims of doctoring

Epic Touch 4G found not to be doctored

Judge Koh has rejected an objection motion filed by Samsung alleging that Apple had tampered with the image of a Samsung phone to make it look more like an Apple product. This latest development comes as the patent battle between between the two electronics giants continued today, and The Verge reports that Judge Koh has had stern words for both sides of the case.

The objection centered on the Epic 4G Touch, which Samsung said does not look how Apple portrayed it when the device is taken out of its box. Samsung produced its own images of the Epic 4G Touch, which it said had been taken last night; images showing a different layout with different home screens.

Apple countered that it had not, in fact, made any alterations to the Epic 4G Touch with the aim of making it look more like an Apple product. Judge Koh then pointed out a number of minor inconsistencies in Samsung's presentation, including the absence of a number of features Samsung claims are present out of the box. Samsung later acknowledged that the image was not taken exactly when Samsung's attorney had previously said.

Koh subsequently found it not credible that Apple had tampered with the phones shown in its evidence. She then instructed both parties to agree in advance on any images to be used in joint exhibits.
