Oracle denies possibility of settlement with HP

Dispute centers around Oracle's Itanium support

Less than 24 hours after a judge refused to rule before trial, an Oracle Corp attorney dismissed the possibility of a settlement with Hewlett-Packard out of hand. HP is seeking $4 billion in damages from Oracle's decision to discontinue Itanium support in the product lineup.

Oracle declared intent to discontinue Itanium support last year. Intel, the producer of the Itanium line, has declared the chip to be in an end-of-life status. HP argued that a settlement from an earlier lawsuit involving executive poaching affirmed Oracle's commitment to the Itanium line.

Judge Kleinberg of the Santa Clara County Superior Court compared the case between the two Fortune 500 companies to a divorce. The dispute commenced last June, when HP sued Oracle over the latter's decision to drop support for Itanium. HP claimed Oracle broke "legally binding commitments" to support servers based on the Intel 64-bit based hardware, and that Oracle engaged in anti-competitive strategies to force HP customers to their own systems. HP has no statement on the possibility of a settlement.
