Image now almost two years old
Apple has won a trademark on the current iTunes logo from the US Patent and Trademark Office, Patently Apple remarks. An application was first submitted almost two years ago, on June 17th, 2010. The logo is now covered under five different International Classes, dealing with fields like retail, entertainment, and telecommunications.
The present logo premiered on September 1st 2010 with the launch of iTunes 10. It replaced the most long-standing version of the logo, dating back to iTunes 2 in 2002. Until 2010 all versions of the image featured a CD as their backdrop, reflecting the one-time popularity of the format, as well as iTunes' own emphasis on ripping and importing discs. In recent years Apple has preferred to market downloads from the iTunes Store, which have grown in both practicality and popularity since the store launched in 2003.

Well, congratulations
Good for them they got the trademark. Still, that icon is boring as h***. I can see why the old "CD" logo didn't work for them anymore, but for crying out loud, it's Apple... surely they could have come up with something more creative than that.
