Motorola made to use current targes in Apple suit

Apple scored a coup Tuesday after a Southern District of Florida court ruled that Motorola couldn't bring more devices and services into its ongoing patent lawsuit. The judge in the case granted a motion to strike the iPhone 4S, iCloud, and iTunes from the alleged patent violations. Its extra arguments are believed to have added too many complications, both through the new products and to the ones already in the case.

Motorola in a last-minute objection had argued that it would "have" to sue Apple again just to make similar patent violation claims. Having two lawsuits could lead to an "inconsistent verdict" on how to interpret certain patents, Motorola argued.

The decision won't offset Apple's losses, which include a denied attempt to freeze the lawsuit and having to deal with one case in the Florida court favored by Motorola, but will limit the impact of Motorola success, if any, to older iPhones. A trial isn't due to start until August and could see Apple dropping all of the iPhones in the lawsuit by the time a final verdict arrives.
