Samsung gets shot at overturning Apple-led ban on August 25

Samsung hearing on Galaxy Tab ban due this month

Samsung will get its first opportunity to contest the EU-wide Galaxy Tab 10.1 ban at a hearing on August 25. The company will get a hearing in a German court at the time to explain why a judge should overturn the Apple-requested preliminary injunction. Any decision would take place weeks later.

The ban will still be in effect for the duration and could keep the Galaxy Tab 10.1 off of most European shelves until September or later.

Apple's ability to get the ban so quickly is now known to have caught Samsung by surprise. Newly recovered details showed that Samsung had challenged the European dispute with a protective brief but that the court had skipped a hearing entirely, instead siding with Apple's request for an injunction. The Samsung argument had been considered, but the claims of perceived damage were considered more urgent.

The ban while it lasts could be severely damaging to Samsung's performance and market share for tablets in what's often one of its strongest markets. Other ban attempts are also underway, including a September 15 Dutch decision that could cut off the only remaining EU country still allowed to sell the larger Galaxy Tab.

    So Samsoung lies

    Samsung criesit had no idea of the injunction, but now we learn it did and had provided a brief to the court. Samsung lied and now, just like Google has done over the parents it lost to the RockStars, is crying like a little b****! Samsung lied! This did not come on of no where! Suck on that Fandroids! LOL
