Google wins legal battle over Android trademark

Judge dismisses suit, cancels original trademark

Google and a number of other companies have finally won an ongoing legal battle over the Android trademark. The judge sided with the companies using Google's mobile OS and dismissed the infringement suit, which was originally filed by Illinois entrepreneur Erich Specht.

Specht was behind a company named Android Data, which received trademark protection in 2002. The startup reportedly fell apart that same year, leaving the company dissolved and the trademark effectively abandoned.

The judge granted Google's motion to throw out the case, agreeing that Android Data had been abandoned. The court took further action to cancel Specht's trademark, as it could cause possible confusion with the Android mobile OS.

In a statement provided to TechCrunch, a Google representative claimed the company was "pleased to see the case dismissed, as it was baseless from the start." Specht had sought $94 million in damages, even though his company reportedly received just $600,000 in revenue from three clients before it went bust.
