Polish site threatened with takedown over Apple references

Apple generally avoiding full-blown lawsuits


Apple's legal team has sent a cease-and-desist request to a popular Polish news site, AppleMania, reports say. The site's name and logo allegedly violate Apple trademarks, which the company also suggests could potentially confuse the public as to the relationship between the two parties. AppleMania is accused of reaping "unfair benefits" that could "lead to the dilution of the distinctive power of Apple's trademarks."

AppleMania is said to have 14 days to respond. Apple has not, however, been aggressive when pursuing action against news sites. A number of them -- such as MacNN, AppleInsider, 9 to 5 Mac -- make references to official trademarks without trouble. Companies sending such cease-and-desists typically have little interest in pursuing a full legal action.

    Nobody's going to confuse this site as belonging to Apple, Inc., but you can't tell lawyers that, or they'd have nothing to justify their existence.

    You mean AppleMania isn't an Apple-branded and sponsored site whose content is controlled by Apple? Oh, man, does Apple have a beef here. I've been going there for years thinking this was an Apple site.

    h***, just look at the home page. It has the word "Apple" on it! h***, they even spelled it the same way Apple, Inc does, with a capital A and all.

    Then there's the end of the word Apple, where the Mania kicks in. It almost looks like a bite was taken out of the 'e', just like one taken out of Apple's apple.

    And I can see, now, that even though the entire home page looks like it could sit right on Apple's servers. Except for the colors, layout, and design, it's a mirror image!

    And, of course, the section labelled "Testy i recenzje" has always been my favorite.
