Judge rules for Telus over Rogers in lawsuit

updated 04:40 pm EST, Tue November 24, 2009

Telus wins advertising lawsuit against Rogers

A judge in the Canadian province of British Columbia has ruled in favor of Telus in a recent lawsuit filed against Rogers for inaccurate ad claims that said Rogers has Canada's most reliable wireless network. Telus argued that since it recently launched its own HSPA network along with Bell, it was on par with Rogers in terms of network reliability.

Justice Grauer concurred with these claims, adding that Rogers could no longer make such claims, as it was based on outdated information. The judge did not, however, order Rogers to pull advertising or any promotional materials but instead told the two parties involved to work together on the wording of a court order and adjourned the proceedings until Friday. Rogers has filed to appeal

This is @RogersKeith. I wanted to share that we filed an appeal today with the B.C. Court of Appeal. We're perplexed by the decision. We continue to believe that our network reliability claim is valid and will take further action shortly.
