'Vista Capable' lawsuit given go-ahead

Vista lawsuits a go

A Seattle court had ruled that two complaints against Microsoft's Windows Vista marketing campaign can proceed to court. District Court judge Marsha Pechman denied a Microsoft dismissal petition, which claimed that plaintiffs Dianne Kelley and Kenneth Hansen lack the standing necessary for a lawsuit. The two have accused Microsoft of deceiving customers through its "Vista Capable" campaign, which attempted to assure computer buyers that their system would be able to run Vista even though it was bought before the January launch.

In reality, say Kelley and Hansen, many systems bearing the label could only run Vista Home Basic, a "stripped down" edition of the OS missing the features defining other versions, such as Aero translucency or Flip3D program switching. Basic machines also have noticeably lower hardware requirements: they need only an 800MHz CPU, 512MB of RAM and 20GB of hard drive space, versus the 1GHz processor, 1GB of RAM and 40GB of storage demanded by Home Premium.

Microsoft has in the past defended itself by saying that it also had a "Vista Premium Ready" campaign, in which it clearly indicated the requirement differences between Home Basic and Home Premium. A trial date for the lawsuit has been set for October. [via InformationWeek]

    BS hype

    All that hype about MS Vista having fancy features apply to the Premium version of Vista. Heck when I picked-up a Vista-Home package and read the back it had two features from a list of uhhh… I dunno twenty features? or maybe more. Apple did a great job with OSX, you get the best full-featured version, no Home edition. I hope they keep it that way.

    MS stories.....at least the bad ones....is because i enjoy hearing the downfalls of this sick, backstabbing cooperation.

    macnn, ipodnn, electonn, whatever can post these all day long as far as im concerned.....as long as they have a happy ending.

    I was going to jump on the bash M$ band-wagon here too and I have couple of things about both sides of this coin - BUT you all are right !!

    The topic of this article is not the discussion_

    I gotta blast MacLeftPodTronistaNN for once again being COMPLETE MORONS and passing it's Macintosh [Apple based] audience news about something COMPLETELY UNRELATED TO Apple or the Mac_

    MacNN [and your various NN flavors] You All Should Think Long And Hard About Changing Your Name To Something Non MAC Based If You Want To Pass On Articles About Non MAC Related News_

    One day the editors will wake up and post some news and realize that no one has posted any comments in a couple of years which will prompt them to look at their traffic logs which will read something like 50 visitors in 6 months and most of those are the editors uploading retarded non-Mac related articles_

    Are we trying to detach ourselves from the rest of the computer industry, or am I reading the comments questioning whether MacNN should post Microsoft stories wrong?

    I think it's a relatively insane concept to say that MacNN or the networked sites should not post Microsoft news, because it's MacNN. Are we supposed to pretend that Microsoft doesn't exist since we use Macs? If there was no Mac news when the editor got to this, then what's the problem? This is a site about Apple, and Apple is part of the computer industry.

    If we didn't know how the competitors were doing how would we measure Apple? Should they say "Apple sales skyrocketing" and not mention that it's still only 6% of the market which is dominated by something that 'doesn't exist to us Mac users'.

    Let's not walk the path of ignorance.
