BBC: Apple faces iPod patent dispute

iPod patent dispute?


Apple , the compay's CEO told the BBC he plans to "aggressively" pursue a US patent that Creative owns on a system used to navigate music on digital players. The report follows speculation that the company would seek royalties from Apple after it said it had won a patent in the US for "the way music tracks are organized and navigated on a player through a hierarchical system using three or more screens." The new video-enabled Zen Vision: M player, positioned to take on the iPod video, look remarkably similar to Apple's iPod designs and offers more features, including an FM radio and a built-in mic and the company has other offerings with iPod-like product names, such as the Zen Sleek Photo and the Zen Nano Plus.

"We will pursue all manufacturers that use the same navigation system," said Mr Sim. "This is something we will pursue aggressively. Hopefully this will be friendly, but people have to respect intellectual property."

Creative's Sim said that it had already begun discussions on the patent with various parties, but refused to provide details, according to the report.

    Before Creative goes out of the music business as well. This lawsuit will be the nail on its coffin. Creative is suing Apple?? LOLLLL Watch the tables turn and Apple destroy Creative for ripping off the whole iPod interface. What a bunch of idiots at Creative!

    in the Christmas season... Creative is hoping to capitalize off the rumors that Apple won't meet demand. By naming and coloring their products, they hope that the unsavvy customer will probably just get their product thinking it's the same thing.

    I wonder what the packaging will look like?

    Apple could claim prior art in its defense as this hierarchical navigation Creative speaks of dates back to NeXTStep. What's the dif? Because Creative used it on a music device makes them entitled to it? Hogwash!

    Well that's great and all, Mr. Sim, except the iPod has been around for much longer than a year. Way to respect intellectual property!

    So Creative is suing Apple for patent infringement while they are blatantly ripping off the exact layout & color scheme of the iPod? Their mothers would not be proud.

    US Patent Issues

    US Patents are way too broad and covering way too basic concepts. And this has been an issue for a long time.

    The answer is simple, some types of intellectual property, should not be considered intellectual property. It's up to society to make that distinction. Protecting the ability of inventors to make a profit is important...and by the way, not because society is about the small minority of inventors, but because we are concerned about the 99.9% of us who are not inventors, but benefit from the inventions...therefore, we need that active marketplace that rewards for creativity.

    but we are coming to the point of absurdity...as people rush off to patent basic concepts, and only the big companies can afford that expensive process, which is really a patent lottery, at this point.

    You should not be able to patent a menu design...period. Nor should you be able to patent a wheel, either. Look and Feel, that isn't a patent issue, but I think the courts are lot more reasonable and in tune on protecting companies trademarks...patent office is still lost in space though.

    jonathan, completely right. that kind of language is a bull, but not a patent. i guess that means I could patent newspapers ... the way that words are positioned on a piece of paper including bold large type words and the use of pictures ... maybe I should try it. or a box that includes electronics and does stuff .... those people in the patent office are ridiculous if they grant patents like the one from Creative.

    A possible solution...

    If the patent issue continues to look bleak for Apple (and so far, it looks like they have lost the battle against Creative), I wouldn't be surprised if SJ went ahead and did a Bill Gates on Creative, i.e. just went out and bought the company, lock, stock and barrel. After that, he would just kill all the unnecessary products that compete with the iPod, leaving all those nice PC sound cards, etc...

    problem with that

    problem with buying out the company is that it can be seen as an antitrust violation, as Apple is the overwhelming market leader in this category, and is starting to get into some hot water for it, ie the Samsung fiasco. I think Creative will sue Apple, so to strike the first blow, and Apple will counter sue based an previous design and the fact that the new ones rip off the look and feel of the ipod way too badly.
