Judge approves iPod battery settlement

updated 09:30 am EDT, Fri August 26, 2005

Battery settlement

Apple should have made customers aware of on first three iPod models, a San Mateo County judge ruled Thursday. Because the company failed to do so, it must replace as many as 1.3 million iPod batteries belonging to owners of first, second, and third generation iPods. Under the settlement, which has now received final approval, those users who already paid Apple to replace their iPod's failing battery are entitled to up to half of that cost back. Steve Williams, lead counsel for the suit that people who bought iPod's first two models are entitled to either $25 cash or a $50 credit at the Apple Store. Owner of iPod's third model are entitled to free replacement battery if the battery fails. Consumers have up to May 2006 to file a claim to be entitled to the settlement. Based on the number of people continuing to make claims, the settlement has a minimum value of approximately $15 million.

    1st Generation

I've got a first Generation iPod and still get a good 6-8 hours of battery out of it.

    A bad decision

Who believes batteries last forever? What adult does not know that batteries die? Where did Apple state that the Batteries will last forever?

    I don't care...

My iPod qualifies. Send me my $50 gift certificate! I'll just spend it at the Apple Store anyway!

I still get 8+ hours from it. I'm not deaf and I know how to treat the battery properly.

    Lawyers

Man, I tell you, always dissing the lawyers. I'll have you know the lawyers in this case will have to get by on only $2.7 million. They probably are taking a loss on this settlement, the poor guys.

    Another idea

I suggest we all file class-action lawsuits against cell phone battery makers. Those things die like flies. So do rechargeable batteries for the home. Let's sue everybody!

    All I know...

All I know is that the time smells right for a brand new Apple keyboard! That sure rubs me the right way.

My iPod (1st Gen) only gets 2-3 hours if that.

    3rd Generation

my 3rd Gen 10GB battery life only lasted about 18 months. I wasn't super thrilled about that. Right now, if its not plugged in, its useless. I may have a look at this suit and see if I qualify.
