Elite amends complaint


Elite Computers & Software filed its third amended complaint against Apple on February 14, 2005. Available for download for download from , co-founder Thomas Armes said that Elite has added three new causes of action. "These are very interesting times as we have come from being Apple Specialists to Legal Specialists! I spend a lot of my time working on the case and I look forward to our day in court." The five current and former Apple Dealers in litigation against Apple Computer recently changed legal teams in December, 2004. "I look forward to our day in court with our new legal team", said Armes. "I believe that in the end, the case against Apple will be overwhelming!"

    Apple will stack...

    ...lawyers on top of you until you stop breathing. You'd be better off spending those lawyer dollars on a nice website like Small Dog.

    I can not comment on Elite Computers but I have made a decent chunk of change cleaning up after many of the questionable Apple VAR's here in NC. Most of them act like big fish in a little pond and give a half assed effort supporting the mac platform. I am glad that Apple is squishing them out of existance. I would have done the same thing if I were Jobs. Apple needed to control the first time buyer's imprerssion their products. With places like Electronic office and Computer Tree f'ing things up it was just not happening here in WNC.

    I am sure there are some high quality VAR's out there I firmly believe they are in the minute minority.

    Ha ha ha! So they changed legal teams in December. Who here thinks their previous counsel tried to explain to them that their case didn't have a leg to stand on?

    Product availability

    With all of this whining that they can't get any product before Apple, how come I got my iPod shuffle a couple of weeks ago from a local reseller when people who ordered from Apple before me are still waiting?

    It seems to me product availability has a lot more to do with their relationship with their distributor than with Apple.

    First they confuse their captured audience leaving for a retailer with good customer service, then they need to switch legal teams, now they can't even build a web site with premade templates correctly. The page is full of HTML errors, there's the label "side" in the side panel, "Untitled Document" in the main pane, etc. What a bunch of maroons.

    I work for a reseller and ordered my lower-end Mac mini, BTO with 512MB RAM, via Apple's reseller online store on January 17 (i.e., same way we'd order it if a client wanted one).

    Still haven't received it. Has anyone ordered a mini from the regular online Apple Store since then and received it?

    Resellers

    The Apple reseller I know of in Minneapolis does a good job. They are in business and continue to do business. I've never heard them bad mouth Apple at all.

    This comes down to resellers that are in a good market and run a good business and in turn make money, to resellers in a bad market or with a bad business model and loose money.

    Which reseller do you think has a problem with Apple? I think this clearly shows the actuality of the situation.
